This Website Privacy Policy (“Privacy Policy”) explains how  Study Group NZ (Auckland) Limited (“SGNZ” or “we”) collect, hold, use, and disclose your personal information, as well as ensure information about you is kept confidential. Any information you are asked to provide using this website will only be used in the ways described in this Privacy Policy.

Introduction

In this Privacy Policy:

  • Study Group means SGNZ’s related bodies corporate that are registered in countries other than New Zealand.
  • SGNZ means Study Group NZ (Auckland) Limited (NZCN: 1012808, NZBN: 9429037376802).

SGNZ respects your privacy and is committed to protecting your personal information. This Privacy Policy will inform you as to how we look after your personal information when you visit our website (regardless of where you visit it from) and tell you about your privacy rights and how the law protects you.

Purpose of this privacy policy

This Privacy Policy aims to give you information on how SGNZ collects, holds, uses, and discloses your personal information through your use of this website, including any information you may provide through this website.

It is important that you read this Privacy Policy together with any other Privacy Policy, Statement or Notice we may provide on specific occasions when we are collecting personal information about you so that you are fully aware of how and why we are using your information. This Privacy Policy supplements the other notices and is not intended to override them.

Complaints

You have the right to make a complaint at any time to the Office of the Privacy Commissioner (OPC) if you allege we have breached you privacy (lodge a complaint online, visit https://privacy.org.nz/, or call 0800803909). We would, however, appreciate the chance to deal with your concerns before you approach the OPC so please contact us in the first instance.

Please provide us with details of the complaint, and a proposal for how you would like us to resolve the complaint. The ANZ Compliance team will normally:

  • acknowledge receipt of your complaint within five business days, and
  • complete an investigation and respond to your complaint within 30 days.

We will determine what (if any) action we should take to resolve the complaint. If the matter is complex and the investigation will take longer, the ANZ Compliance Team will contact you with an estimated response time.

It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes during your relationship with us.

Purposes for which we collect, hold, use and disclose personal information

Personal information, means information or an opinion about an identified individual, or an individual who is reasonably identifiable. It does not include information where the identity has been removed (anonymous information).

We may collect and use your personal information in order to enter into- and perform a contract with you, or based on our legitimate interest of fraud prevention, safety and security; error detection and rectification; marketing our services; or analytics in terms of visitors’ website use and their experience in order to improve the service. Sometimes we may seek your consent or get in touch based on the contact email you left on our website, of which you can always opt-out by clicking a link in our correspondence or emailing us at anzcompliance@studygroup.com.

We may have to disclose your personal information to companies within Study Group for the above purposes.

We do not allow our third-party service providers to use your personal information for their own purposes and only permit them to process your personal information for specified purposes and in accordance with our instructions.

The information we collect and hold about you

We may collect, hold, use, store, disclose and transfer different kinds of personal information about you which we have grouped together follows:

  • Information you give us. You may give us information about you by filling in forms on our site or by corresponding with us by phone, e-mail or otherwise. Students are asked to supply information to SGNZ when applying for enrolment, at orientation sessions and during the periods of study. This includes information when applying for enrolment, at orientation sessions, during periods of study and information that you provide when you register to use our site, subscribe to our service, search for a product, and when you report a problem with our site. The information you give us may include your name, address, telephone number(s), email addresses(s), date of birth, gender, country of birth, nationality, citizenship country, passport details, academic and English language attainments, disabilities, health information, including illnesses, allergies and dietary Information. SGNZ may also collect information regarding payment of fees.
  • Information we collect about you. With regard to each of your visits to our site we may automatically collect the following information:
  • Technical information, including the Internet protocol (IP) address used to connect your computer to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform;
  • Information about your visit, including the full Uniform Resource Locators (URL) clickstream to, through and from our site (including date and time); products you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page and any phone number used to call our customer service number.
  • Information we receive from other sources. We may receive information about you if you use any of the other websites we operate or the other services we provide. We are also working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies) and may receive information about you from them in relation to your expressed interest in our services and information required to enter into a contract with you such as creditworthiness.

We may also collect, hold, use and disclose aggregated information such as statistical or demographic information for any purpose. If you fail to provide personal information

Where we need to collect personal information by law, or under the terms of a contract we have with you and you fail to provide that information when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with services). In this case, we may have to cancel services you have with us but we will notify you if this is the case at the time.

Advertising and Remarketing Cookies – SGNZ uses 3rd party vendor re-marketing tracking cookies including the Google Adwords tracking cookie. These tell us when a user arrives on our site by clicking on one of our paid adverts. We also use Google Adwords Remarketing to advertise the Study Centre across the internet. Remarketing will display relevant ads tailored to you based your prior use of our website, through cookies placed on your machine.

These cookies do not in any way identify you or give access to your computer or mobile device. These cookies allow us to tailor our marketing to better suit your needs and only display messages relevant to you.

Information security

We have put in place appropriate security measures to prevent your personal information from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal information on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

Intellectual property rights

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organisation to content posted on our site.

We do not guarantee that our site will be secure or free from bugs or viruses.

How long will you use my personal information for?

We will only retain your personal information for as long as is necessary either to fulfil the purposes we collected it for or for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorised use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and any applicable legal requirements. After this period we will use our best endeavours to securely destroy your personal information.

In some circumstances we may anonymise your personal information so that it can no longer be associated with you, in which case we may use such information without further notice to you.

Your legal rights

Under certain circumstances, you have the following rights under privacy laws in relation to your personal information:

  • Request access to your personal information. This enables you to receive a copy of the personal information we hold about you. We may charge a fee to cover our reasonable costs of locating and providing your personal information.
  • Request correction of the personal information that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected, unless there is a law that requires us not to. We may need to verify the accuracy of the new information you provide to us.

If you wish to exercise either of the rights set out above, please contact the ANZ Compliance team at anzcompliance@studygroup.com. If we refuse to give you access to, or correct, your personal information, we will notify you in writing and set out the reasons.

No fee usually required

You will not have to pay a fee to access your personal information (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

What we may need from you

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal information (or to exercise any of your other rights). This is a security measure to ensure that personal information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond

We try to respond to all legitimate requests within 30 days. Occasionally it may take us longer than 30 days if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
